1.  Terms of Use

By using this website, you have agreed to the conditions of use, personal responsibilities and legal guidelines governing its use. If you do not agree to these Terms and Conditions (the “Terms”) , you must not continue to access or use this website (the “Website”) . Please read the Terms carefully. 

We may update the Terms from time to time. Please review the Terms periodically to stay informed of any changes. The most recent version of the Terms, as posted on the Website, supersedes all prior versions.

2.  Intellectual Property

This website is powered by OpenCart, a free open-source e-commerce platform. Additional functionality and graphical elements are also provided by the Journal 3 theme and framework.

The PDF viewer used in the Website is a modified version of the prebuilt viewer in PDF.js (version 2.4.456), an open-source JavaScript library. The original source code is used under Apache License Version 2.0 and is Copyright 2020 Mozilla Foundation. All DRM related modifications to this code are Copyright 2025 BioAccess Australia.

The Website and its content are protected by copyright, trademark, and other intellectual property laws. Unauthorized use of any content constitutes a breach of these Terms and may violate applicable laws. All publications, images, videos, text and graphics displayed on the Website, excluding the graphical elements provided by OpenCart, Journal 3 and PDF.js, are Copyright BioAccess Australia.

3.  Warranties and Limitations on Liability

The Website and its content are provided “as is” and “as available.” BioAccess Australia does not guarantee uninterrupted or error-free access and disclaims all warranties, express or implied.

To the maximum extent permitted by law, BioAccess Australia is not liable for any indirect, incidental, special, or consequential damages, including those arising from misuse of Website content. Nothing in these Terms limits any non-waivable warranties or mandatory consumer rights under Australian law.

4.  Prohibited Usage

The following actions are strictly prohibited:

  • Archiving, downloading, copying, printing, or redistributing streamed ePublications and purchased images (except as permitted under the license detailed in Section 6 below).
  • Using automated tools (e.g., bots, spiders, screen scrapers) to access, extract, or modify secured Website content.
  • Circumventing or tampering with the Digital Rights Management of the PDF viewer, including attempting to bypass controls and source code modifications that restrict printing, saving, downloading and copying.
  • Reproducing or adapting content for use in marketing, advertising, or trademarks.
  • Using content in any obscene, defamatory, or unlawful way.
  • Public display, classroom use, or broadcasting of streamed ePublications.
  • Recording or capturing streamed ePublications by screen recording, screenshots, or similar methods.

Any such misuse may result in account termination and legal action.

5.  ePublications

When you purchase an electronic publication (ePublication), you are granted a perpetual, non-exclusive, non-transferable license to view the publication using the integrated PDF viewer on the Website. To view the content, you must be signed in to your customer account. This access is for personal, non-commercial use only and excludes public broadcast or educational purposes.

You may access your purchased content from any device but only one device or browser session at a time. If multiple logins are detected, only the most recent session will remain active after a 10-minute grace period. Prior sessions will be automatically logged out to protect your account. Sharing login credentials with others is a breach of our Terms and may result in account suspension.

We recommend using the “Preview Publication” link on the product page to make sure you are fully satisfied with the product before purchase. All purchases are final and non-refundable.

Access to ePublications may be suspended or revoked if these Terms are violated.

6.  Purchased Images

Each purchased image includes a non-exclusive, restricted license to reproduce the image in a single edition of a printed publication. In some cases, this license may be extended to include electronic versions of the same title if prior permission is obtained from BioAccess Australia. Please use the contact form on the Website to request permission.

The license is non-transferable except when purchased on behalf of an employer or client for the stated purpose, in which case you represent that you have authority to bind that party to these Terms.

As a condition of this license, you must:

  • Provide attribution to the photographer/artist as specified on the product page.
  • Notify BioAccess Australia of publication details (title, expected date) using the contact form on the Website.

The license excludes:

  • Use in promotional materials.
  • Use on websites or social media.
  • Use in other unrelated or future publications.

7.  Password Security and Personal Information

You are responsible for maintaining the confidentiality of your login credentials. Password sharing is prohibited.

You must also ensure that your account information is accurate and up to date. Please log in to "My Account" to update your account information.

8.  Electronic Communications

We will communicate with you, when necessary, by email using the email address you provided during registration of your account. You may also elect to subscribe to our Mailing List (for email notifications of policy changes and new products or promotions) when first registering your customer account at the Checkout. By default, the "Subscribe to Mailing List" checkbox is ticked but you may untick it if you wish before confirming your order. Alternatively, customers may subscribe/unsubscribe at any time under "My mailing list preference" in their account.

9.  Cookies

To protect your privacy, we use the minimal number of cookies possible. The cookies we use are strictly necessary for the Website to function correctly and securely. Please refer to our Cookies Policy for details.

By accessing and using the Website or by confirming agreement to the Terms and Conditions at the Checkout, you consent to our use of these cookies.

10.  Termination

We reserve the right to suspend or terminate your access to the Website or any content without notice if you violate these Terms or misuse the platform.

11.  Governing Law

These Terms are governed by the laws of the State of Queensland, Australia. Any disputes shall be resolved exclusively in the courts of that State.

12.  Acceptance of the Terms

By accessing and using the Website, you confirm your acceptance of these Terms. You will also be asked to confirm your agreement during the checkout process when making purchases.
